ai by Chuck Terms of Service

Effective date: November 9, 2026

These Terms of Service ("Terms") are an agreement between you (the business signing up, "you" or "client") and Wilcox Brand LLC, a Pennsylvania limited liability company d/b/a ai by Chuck ("ai by Chuck," "we," "us"). They cover every plan you buy from us. By starting a free trial or paid plan, you agree to these Terms.

1. Our plans

Standard: $150 per month (Site).

Most Popular: $299 per month (Site + Phone & Reviews).

Premium: $699 per month (Own the Town).

Prices are plus applicable tax. What each plan includes is listed at https://www.aibychuck.com. Custom packages are available by written quote, and the quote controls where it differs from these Terms. All plans are month-to-month with no long-term contract. We lease your website to you as part of your plan; we don't sell it.

2. Free trial and automatic renewal

Every plan starts with a 30-day free trial. A card is required at signup. If you don't cancel during the trial, your first charge is on day 31, and your plan then renews automatically every month at the plan price plus tax until you cancel. Cancel before the trial ends and you pay nothing.

We'll email you a confirmation with these terms and how to cancel when you sign up, and a reminder about 7 days before your trial ends. One free trial per business.

3. How to cancel

You can cancel any time:

If you cancel during the trial, you won't be charged. If you cancel a paid plan, it ends at the end of your current billing period, and your service continues until then. We don't give partial-month refunds, except where the law requires it or Our Guarantee says otherwise. We confirm every cancellation by email.

Price changes: if we change the price of your plan, we'll email you 7 to 30 days before the new price takes effect, with how to cancel.

4. Our Guarantee

Sign up for our premium package, Own the Town, and if after 3 months you can honestly say it wasn't worth it, we'll give you our Standard website plan free for 12 months.

How it works: Start with the 30-day free trial, then stay on Own the Town for 3 paid months ($699/mo plus tax). The trial month doesn't count. If after those 3 paid months you can honestly say it wasn't worth it, email hello@aibychuck.com any time before your 4th monthly charge. We'll cancel your Own the Town plan before that charge and give you our Standard website plan ($150/mo value) free for 12 months from the date you claim. No refund of past payments. No card or payment is needed for the free plan. When the 12 months end, nothing renews automatically: we'll ask before any charge, and if you don't choose to continue, the free plan simply ends. One per business; your account must be paid up when you claim. We don't promise rankings, leads or sales.

5. No guaranteed results

We work hard to help your business get found and get calls, but we can't promise any search ranking, number of calls, leads, reviews, sales or revenue. Results depend on your market, competitors, search engines and many things outside our control, and they vary from business to business.

6. How we use AI

Our services are delivered largely by AI systems, with human oversight. AI output can contain mistakes. Please review the content we prepare for you (site text, posts, replies, summaries) and tell us about errors before you rely on it. You're responsible for approving what goes out under your business name.

7. Your responsibilities

You agree to:

• Give us accurate, current information about your business.
• Only give us content (text, logos, photos, reviews, customer lists) you have the right to use.
• Run a lawful business and use our services lawfully.
• Review and approve our work in a reasonable time. Delays on your side may delay our work.
• Own your relationships with your customers and follow the laws that apply to your business, including licensing, advertising and consumer laws.

8. Who owns what

Your content: you keep ownership of your own text, photos, logo and business information. You give us a non-exclusive license to use, copy, edit and display that content only to provide and promote your service while your plan is active.

Our materials: Wilcox Brand LLC owns its designs, templates, layouts, code and tools. We may reuse them for other clients, but we never reuse your content (your text, photos, logo, name or reviews).

Domains: domain names we register for your site are registered to and owned by Wilcox Brand LLC and are included in your plan while it is active. When you cancel, Wilcox Brand LLC keeps the domain. Your site comes down, and we stop using the domain for your business. Domains aren't transferred for free; a transfer is available on request for a fee we'll quote at the time.

After cancellation: your site comes down at the end of your paid period. You may ask for a copy of your own content within 30 days after that, and we'll send it.

9. Phone, text and review services

If your plan includes phone or review services:

• You're responsible for having the consent the law requires before we call or text your customers for you. We don't send marketing texts to anyone without their consent, and anyone can reply STOP to opt out.
• Calls may be recorded and transcribed only with the notice the law requires. Pennsylvania generally requires the consent of everyone on a call to record it. Recorded lines play a short greeting at the start of each call telling callers the call may be recorded.
• Review requests go to all of your customers, not just happy ones. We don't offer rewards for reviews, filter out unhappy customers, or post fake reviews, following Google's review policies and the FTC's rule on consumer reviews.

10. Acceptable use, suspension and termination

Don't use our services for anything illegal, deceptive, infringing, hateful or harmful, or for spam or malware. We may refuse or remove content that breaks these rules.

If a payment fails, Stripe will retry it and we'll email you. If it's still unpaid, we may suspend your service after at least 7 days' notice by email. We'll restore it once you're paid up.

You can end your plan any time as described in Section 3. We may end your plan with 30 days' email notice for any reason, or right away if you seriously break these Terms or the law. If we end your plan without cause, we'll refund any prepaid amount for time we don't provide.

11. Disclaimers, limits on liability and indemnity

To the extent the law allows, our services are provided "as is" and "as available." We don't promise they'll be uninterrupted or error-free, and we rely on outside providers we don't control.

To the extent the law allows: we aren't liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or data; and our total liability for any claim relating to our services is limited to the fees you paid us in the 3 months before the claim.

You'll defend and indemnify Wilcox Brand LLC against third-party claims that arise from content you gave us, your business, or your breach of these Terms.

12. Disputes and governing law

If you have a problem, email hello@aibychuck.com first and give us 30 days to try to fix it. If we can't, Pennsylvania law governs these Terms, and any lawsuit must be brought in the state or federal courts for Luzerne County, Pennsylvania (the Luzerne County Court of Common Pleas or the U.S. District Court for the Middle District of Pennsylvania). Nothing here stops either of us from using small-claims court.

13. Payments

Payments are processed by Stripe. We never see or store your full card number. The charge may appear on your card statement as ai by Chuck or similar.

14. Changes to these Terms

We may update these Terms by posting a new version here with a new effective date. For material changes, we'll email you before they take effect. If you keep using our services after that notice, you accept the new Terms. Price changes always follow the 7-to-30-day notice in Section 3.
